 By seizing such powers, the President has willfully violated Article 1, Section 1 of the Constitution. The United States

has been in a state of declared national emergency for more than sixty years. The following presidents have made

official declarations of national emergency:

- March 9, 1933, declared by President Roosevelt; and

- December 16, 1950, declared by President Truman in Proclamation No. 2914; and

- March 23, 1970 and August 15, 1971, declared by President Nixon in Proclamation No. 4074.

 

Those provisions of these declarations that related to Section 5(b) of the Act of October 6, 1917 as amended, persist

to this day.

Since 1976, presidents have declared ongoing national emergencies as follows:

- November 14, 1979, declared by President Carter in Executive Order 12170. President Clinton extended this emergency on November 1, 1993. He declared that the state of emergency "must continue in effect beyond November 14, 1993;" and

- April 17, 1980, declared by President Carter in Executive Order 12211; and

- January 7, 1986, declared by President Reagan in Executive Order 12543. President Clinton extended this emergency on January 3, 1996; and

- August 2, 1990, declared by President Bush in Executive Order 12722, extended by President Clinton on July 28, 1995. President Bush also declared national emergencies on October 4, 1991 (Executive Order 12775, extended beyond September 30, 1993), November 16, 1990 (Executive Order 12735, extended beyond November 16, 1993) and May 30, 1992 (Executive Order 12808, last extended on

October 25, 1994); and

- September 30, 1990, declared by President Bush in Executive Order 12730. Some aspects were terminated on September 30, 1993. President Clinton renewed the emergency on June 30, 1994 in Executive Order 12923, and extended it again on August 16, 1995; and

- President Clinton has declared national emergencies on September 27, 1993 (Executive Order 12865), September 30, 1993 (Executive Order 12868), November 14, 1994 (Executive Order 12938), January 24, 1995 (Executive Order 12947), March 15, 1995 (Executive Order 12957), October 21, 1995 (Executive Order 12978), and March 1, 1996 (Presidential Proclamation 6867).

 

The unending state of national emergency continues. This list does not include declarations of national emergency which

have been later revoked (in 1985 and 1988).
