General Information

It is most interesting to note that laws are supposed to be simple and easy to understand.

Check the 6th Amendment: "... and to be informed of the nature and cause of the accusation." It can be argued that one is not informed if one can not understand the law.

Check Madison in the Federalist Papers No. 62: " It will be of little avail to the people that the laws are made by men of their own choice if the laws be so voluminous that they cannot be read, or so incoherent that they cannot be understood; if they be repealed or revised before they are promulgated, or undergo such incessant changes that no man, who knows what the law is today, can guess what it will be tomorrow. Law is defined to be a rule of action; but how can that be a rule, which is little known, and less fixed? " (See Fiedor Report #46.)

The White House Virtual Library under the Clinton Administration is mobile and unreliable. See List-13083 for that story.

Jon Roland's Constitution site is a well respected and handy site for research on Constitutional law.

Blackstone's Commentaries, Tucker version, in the Constitution site are highly recommended. Wrote Doug Fiedor, author of the widely read Heads Up Newsletters, "That was our country's very first law book. Professor Tucker knew Washington, Madison and many others. So, when he was writing this country's very first law book about our Constitution, he sometimes went down the road and asked questions of the people who actually wrote that document ."

Of significant value are the Federalist Papers, written by our Founding Fathers as they considered the Declaration and Constitution. Again, courtesy the Consitution.org site.

Federal Jurisdiction by Lowell Becraft is well worth studying.

Treaties: a Source for Federal Municipal Power by Lowell Becraft examines treaty power.

Limited Federal Government by Forest Glen Durland contains lots of useful documentation. It was written to help the farmers in the Klamath Basin water crisis.

Cato did an interesting study on using EOs to legislate.

2-19-01 Bush is considering the illegality of many of Clinton's EOs.

4-28-03 - Bush let Clinton's last minute batch of EOs become law and rescinded none of Clintons EOs.

There is no statute defining use of EOs. An EO defines the use of EOs.

Using EOs as legislation goes back to Washington.

EO 12656 - Reagan - Plan for national emergency.

EO 12919 - Clinton took the use of EOs to an art form.

 

Truman cited a UN resolution to execute an order. Congress did not challenge him.

Regan implemented SALT without a Congressional approval. Congress did nothing about it.

EO 13107 - Clinton usurped the Senate's power to approve treaties.

 

Note: EOs without numbers have been given names indicating their purpose.

EOs with letters behind them are not EOs, but were labled that way for grouping and access.

 

Files pertaining to EOs have given the EO number with a letter attached to denote its nature. This keeps all the information regarding an EO together, which is very convenient. Following are the meanings of the added code letters: 

By starting with the pertinent EO, all files pertaining to that EO are all together. That is mighty convenient, let me tell you.

 

eo12345c = classified document

eo12335d = deletes or suspends an order

eo12335e = emergency status. These are terribly important,

for with two magic words, national emergency, Clinton can declare martial law, and don't think for a moment he won't use it.

eo12335i = index entries to many other documents

eo12335m = memo, memorandum

eo12335n = NES - National Emergency Status. These are terribly important,

for with two magic words, national emergency, Clinton can declare martial law, and don't think for a moment he won't use it.
