Mr. BARR of Georgia (for himself, Mr. SAM JOHNSON of Texas, Mr. COLLINS, Mrs. CUBIN, Mr. EVERETT, Mr. POMBO, Mr. BARTLETT of Maryland, Mr. NORWOOD, Mr. CRANE, Mr. ENGLISH, Mr. LAHOOD, Mr. STEARNS, Mr. GRAHAM, and Mr. CHABOT) introduced the following bill; which was referred to the Committee on the Judiciary, and in addition to the Committee on Government Reform, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned
To restore the division of governmental responsibilities between the Federal Government and the States that was intended by the framers of the Constitution by requiring all Federal departments and agencies to comply with former Executive Order 12612.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Federalism Preservation Act of 1999'.
SEC. 2. COMPLIANCE WITH FEDERALISM PRINCIPLES APPLICABLE UNDER FORMER EXECUTIVE ORDER. (a) COMPLIANCE REQUIREMENT-
The head of each Federal department and agency shall ensure that each activity carried out by the department or agency, respectively, is carried out in accordance with the provisions of Executive Order 12612, as in effect on October 26, 1987.(b) LATER ORDER OF NO FORCE OR EFFECT- Executive Order 13132 (issued August 4, 1999) shall have no force or effect.
Note: Forest Glen Durland maintains that HR 2960 must also negate EO 13083.
The following could be added to the above:
(b) OTHER ORDERS OF NO FORCE OR EFFECT - Executive Orders 13132 (issued August 4, 1999) and 13083 (issued May 14, 1998) shall have no force or effect.
EO 13083 has merely been suspended. That suspension could be removed by Clinton in a heartbeat by covertly inserting one line deep inside a huge, omnibus bill. The use of funds likewise. Now is the time to negate EO 13083.
Forest still recommends his NES Off Switch to rein in this executive nonsense. It's simple.
Federalism Executive Order (E.O. 13083/13132) - In May 1998 President Clinton, while in Britian [sic.] visting Prime Minister Tony Blair, signed Executive Order 13803. This Executive Order would have provided justification for any federal agency to supercede federal or state responsibilities with virtually no limitations. Later in 1998, we were successful in having this E.O. recinded; however on August 5, 1999, President Clinton reissued the Federalism Executive Order, now numbered E.O. 13132. While making cosmetic changes to address some of the concerns of state and local governments, the basic power grab contained in the previous E.O. remains. In other words, E.O. 13132 is every bit as bad as E.O. 13083. We were able to get rid of E.O. 13083 only because of the overwhelming numbers of e-mails, letters and calls from concerned citizens and organizations. On September 28, 1999, I introduced H.R 2960. This bill will repeal E.O. 13132 and reinstate Reagan's Executive Order 12612 which effectively defined federalism to restore the division of governmental responsibilities between the Federal Government and the States that was intended by the framers of the Constitution. It requires all Federal departments and agencies to comply with this former Executive Order 12612. We will continue to work to push this legislation to a vote; however, without constant and strong public involvement, we will not succeed.
