WATCHING THE DOG WAG

It's really a lot of fun to watch a legal free for all between three teams of attorneys, a few socialists, a communist dictator and a clamorous crowd that often seems to be looking for an excuse to riot. Sweetening the plot, all of the lawyers seem to be intentionally dragging their feet by filing the wrong papers in the wrong courts, toying with the law with quaint redefinitions, calling in a host of dubious "experts" to help cloud the other side's positions, and whatever.

Fanning the flames, of course, is the liberal national media. The national media is interested because it's an easy story to cover and communists are involved. Also, the White House wants complete coverage, no matter how bad the actions of government look.

The truth is, the whole thing looks like a big scam from where we sit.

For instance, that crowd activity -- and that crowd IS under someone's control -- looks surprisingly like what would (or should) happen if an Army Special Forces team were pushing a propaganda program to incite political response. A quick glance at the group shows some well dressed local people who must have things like jobs to go to and homes and families that need attention. So, there must be three or four sets of crowds for this matter. Apparently, scheduled crowds.

And then there's the main civilian players at the Miami house. They seem to always be home. No one works, apparently. The story is that they are paid by a rich benefactor to act like the aggrieved and keep the crowd and media entertained. As long as this charade keeps up, they get to be on television every night, get free cell phones to talk on and have all their expenses paid. They even have their own special spokesman on hand to deal with the media.

All this small group of "family" has to do to get paid is to keep showing the center of attraction -- the six year old little boy -- twice a day, on cue. Oh, and of course they must also make the kid look like a carefree, happy, little boy nonchalantly playing in the yard. He must also act oblivious to the noisy crowd, the ever-present squads of police, the platoons of reporters, and the many prying TV cameras pointed at him.

They trained that kid rather well, it appears. He's going to be quite the TV trooper by the time he is ten years old. But, that they are also messing with the kid's mind while pulling off this three ring circus should be indisputable to any adult with children.

Now comes the lawyer for the communist dictator: Gregory Craig. We find it interesting that the communist side hired the attorney for John Hinckley, the attempted assassin of President Reagan. As a criminal defense lawyer, Craig also defended Bill Clinton. So, we also find it rather interesting that Greg Craig can fly back and forth between Washington and Havana almost at will. Rather than the communist dictatorship, a national church lobbying group is said to be paying Craig out of "special funds." Sure. And who is the "special" contributor behind the scenes? The media don't seem to want to ask that.

Apparently, this same group paid to have the kid's father, step-mother and step brother flown here on a private (American) jet a couple weeks ago.

So, let's see here. Someone gives the Miami family a bunch of bucks to stay home and keep things active there. Their legal fees for a couple lawyers are also paid, as is their always on call spokesman. A lawyer for the boy is being paid by someone, Papa and stepmother came to the U.S. in a private jet, sporting a new wardrobes that almost fit. And Castro gets Clinton's defense lawyer. Interesting!

Clinton gets a direct line to Castro. Reno is directed to run interference for the whole scam. INS is little more than an afterthought. The Reno Justice Department looks like the biggest bunch of idiots that ever populated that building. And a bunch of Cuban refugees in a little house in Miami get their couple hours of international fame -- with pay.

Too bad that's not the whole of the story, though. As we said above, this is a scam. Actually, this looks like a very good "Wag the Dog" scenario. Because, look what big Clinton and Gore scandals did not get much play in the press while the media was busy watching a little Cuban boy:

Maria Hsia, a Gore fund-raiser for over a decade, was convicted for laundering communist funny money into the Clinton & Gore campaign. The new special prosecutor hinted that there may well be some indictments with the Clinton name on them forthcoming. Both Bill and Hillary Clinton may soon be disbarred. Judicial Watch uncovered lots of very good stuff that should have made headlines. A federal judge said that Clinton violated the Privacy Act, which is a felony. Tony Coelho, Gore's campaign chairman, may soon be indicted for a couple interesting felony frauds. A couple hundred thousand White House e-mail messages and a stack of telephone records that were subpoenaed years ago by the Justice Department, special prosecutor and various Congressional committees suddenly turned up again -- way too late for the impeachment. And . . . well, there's more, but you get the idea.

The liberal national media is under the control of the liberal White House. So, the news we get is all Elian all of the time. The national media have no time for the Clinton, Clinton & Gore scandals.

The Dog is Wagging.


So, on Holy Saturday, the federal government did what the federal government does best: The Clinton administration sent a squad-fire team, armed with fully automatic assault weapons and dressed in urban warfare paraphernalia, to capture a little six year old boy. They busted a few heads on the way in and gassed a few people on the way out. But, no one got killed this time.

Because of continuous mishandling by everyone concerned, this was, of course, a no win situation no matter what happened. Still, where two social workers dressed in skirts and blouses would be appropriate (with police looking on from a distance), the administration used an assault team to raid the house early in the morning. Apparently, the Justice Department believes their dubious "Rule of Law" is now secure.

The best thing that could happen to all of these people is that they be sent to stay in a small town in someplace like Northern Michigan, Kansas, Iowa, or Nevada -- far away from the prying eyes of the media and the bickering of those insufferable attorneys. Otherwise, this is but the mid-game of this scenario, not the end.

 

WHAT IS CORRUPT

Attorney General Janet Reno again says she is "studying the law" to determine if criminal charges for illegal campaign finance donations are warranted. Maybe we can give her a little help.

Secretary of Commerce Ron Brown personally shook down hundreds of business people for campaign "donations." Regulations were changed, special favors were given, free trips and meetings were sponsored, and favorable changes in the law were proposed for major campaign "contributors." Under Brown, the whole Department of Commerce was little more than shake-down agency for the financial arm of the president's reelection campaign and the Democratic Party. Brown might be dead now, but others involved in selling special favors are still at Commerce (and other federal agencies).

Then, as painfully evident as a thumb freshly smashed with a hammer, there's the China connection. Certainly, there was at least one Red China mole within the administration. There were also four or more others funneling illegal Communist Chinese money into the Clinton, Clinton & Gore campaign fund. That fact has become so glaringly obvious that even the liberal New York Times, LA Times and Washington Post newspapers have written about it. About the only verification missing is a sworn statement confessing the deed(s) from the communists running the evil Chinese government.

Major news reports place co-president Hillary, and/or her secretary, collecting campaign funds from Chinese operatives right in the White House. Normally, campaign finance laws would not apply to the First Lady. However, Hillary wants to interfere in government and in fact ran the dirty tricks section of the White House. Therefore, she is culpable and should also be charged.

On the other hand, Ozone-Head Al is specifically required to follow all campaign laws. And, after sixteen years in Congress, Gore knows perfectly well that it is a federal felony to hustle campaign contributions while on federal property. Gore admitted publicly to making illegal fund-raiser telephone calls to major campaign contributors from White House offices. The penalty is three years in prison for each occurrence, and we know of at least fifty.

All this happened after the White House legal council had already made it a point to inform everyone that hustling campaign contributions on federal property was specifically against the law. Gore's illegal fund-raising activities, of course, had Slick's (and the co-president's) approval.

Ozone-head's actions are especially onerous. Many contributors called Gore's fund-raising pitch little more than a heavy-handed shakedown. Most of these people had millions of dollars of business with the federal government, and so would be very susceptible to slight changes in federal law or regulations. They couldn't afford to take a chance of not contributing.

And Gore's reply? "I'm proud of what I did. I did not do anything wrong, but I will not do it again." Then he tried to say that the words "any person" in the law do not apply to him. Whew!

On October 6, 1993, Clinton signed into law the Hatch Act Reform Amendments of 1993. At that time he announced: "The federal workplace, where the business of our nation is done will still be strictly off limits to partisan political activity." The White House is one such "federal workplace."

Yet, since then, nearly everything this administration did involved partisan politics and one reelection campaign or another.

So, while Janet Reno still states the need to "study" the law, one thing seems quite evident to most everyone else: This administration violated every single campaign finance law on the books -- and, at least a few times each. And, each and every violation is a felony offense.

The facts are clear. Now is the time for Congress to act. There is no reason to wait for Janet Reno to "decide," or for a special prosecutor to investigate. Congress must enforce the law. And the only way Congress can legally do this is by impeaching the whole of this administration.

Indeed, to not begin impeachment proceedings immediately is to prove to many American citizens their worst fears: Members of the central government really are, in fact, above the law.

 

RESIST GOVERNMENT SNOOPS

Words mean things, as Rush Limbaugh likes to say on his national radio program. And lawyers, so they would have us believe, are the legal word merchants of the United States. So it is with great interest that we notice that the rooms full of lawyers working in the White House, Department of Justice and FBI all seem to be having a definite problem understanding some of the simplest words in the English language: "Shall Not."

For instance, the Fourth Amendment to the United States Constitution clearly states that:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

 

Notice the words "shall not be violated"?

Recently, the Supreme Court said that in all but a very few circumstances, officers serving a search warrant must knock, announce their reason for being there and wait to be let in. No "dynamic entries" are allowed unless the police are going after known killers, or some such demonstrably dangerous perpetrators.

American citizens are to be informed of what is to be searched, and what police are looking for, BEFORE the search begins. Police are to show the person to be searched the warrant, and allow them to read it, before the search takes place.

The right to be secure against government intrusion in your "persons, houses, papers, and effects" would also include a ban against pat-downs on the street, looking through medical and financial records, reading of mail, recording private conversations, reading computer e-mail, and listening to telephone conversations.

Police may stop you and ask questions. But a free citizen need not answer if they do not wish. And, unless the officer indicates that you are being detained, a free citizen may leave the presence of the officer at any time. In other words, except during the performance of a criminal investigation (and civil citations), or in an emergency, a police officer has no special powers over and above any other citizen.

Yet, the Department of Justice and the FBI cannot understand "shall not." Rather, they have plans to monitor thousands of American citizen's telephone calls simultaneously. They are also gearing up to monitor many American citizen's e-mail every day. And, all this, they hope, without the necessity of a court approved search warrant.

The Fourth Amendment words "shall not," of course, bar these federal government activities. But, federal law enforcement does not seem to feel that the Constitution applies to their functions. Neither do two members of the Senate (McCain and Kerry), as evidenced by last year's S. 909, which would have allowed federal agents access to all computer correspondence without the necessity of first obtaining a court approved search warrant.

We, of course, have some recourse in this matter. We should start randomly encrypting some of our e-mail messages.

A couple years ago, Qualcomm, Inc. announced that they have mated PGP with their very popular e-mail software, Eudora Light and Eudora Pro. Other software publishers are following suit. This makes encryption both convenient and very easy to use. (Anyone interested can write for my public key.)

We should all make an attempt to tell the federal government that we will resist any and all intrusions into our personal privacy. We would never consider giving government agents the keys to our house and car, just in case they may want to snoop through our stuff someday. We shouldn't allow them to read our e-mail, either. Encrypting e-mail with PGP is a great way to put a halt to that bureaucratic foolishness.

MUSING ON LIBERTY

Thanks to a thought provoking letter from an author/talk show host/journalist/Heads Up reader a while back, an interesting revolution concerning liberty came to mind.

We Americans do not know what Liberty is. We (those of us under 80) have never experienced real liberty in our lifetime.

Oh sure, Roosevelt didn't start bringing actual socialism to the United States until after 1933. But even the adults living then did not realize the true benefits of a fully Constitutional form of government because they were living during a depression.

Academically, in concept, we know what Liberty and a Constitutional form of government means. Yeah, in theory we know. But not practically. In reality, we Americans have no experience with the freedom intended by the Founding Fathers, and we have no one to tell us about it.

As a nation, we are missing our "institutional memory" concerning liberty and freedom. Hence, we have no real idea of exactly what we are missing, were the federal government to be operated Constitutionally.

Isn't that a bummer! We have zero practical experience with liberty. We're Americans. Yet, we have never once lived under that Constitutional form of government designed for us by the Founding Fathers.

So, no wonder we don't miss it. None of us have ever seen it. No wonder there are no riots in the streets demanding the return of Liberty. We cannot ask for the "return" of something we have never had. And no wonder the government feels free to control everything in our lives from womb to tomb. None of us are doing much complaining about it.

This has been going on so long, most Americans actually think government is supposed to do things that way.

The Constitution? Oh yeah; that's that old document kept under glass in Washington. The problem is, we Americans can no longer remember exactly what it was for.

 

Just as an aside here: We at "Heads Up" would honestly like to have a shot at living under a truly Constitutional form of government. We would like to try life with all of those individual rights and liberties George Washington, James Madison and the guys at the Constitutional Convention intended for us.
